A former San Antonio police officer who shot a teenager while in his car in a parking lot at McDonald’s has been arrested on two counts of assault, police said Tuesday.
James Brennand, who was an officer with the San Antonio Police Department when the shooting took place, turned himself in on Tuesday and was arrested, Police Chief William McManus said.
Police filed two counts of aggravated assault by a civil servant against Brennand on Tuesday, police said.
He was fired two days after the October 2 shooting.
Erik Cantu, 17, remained unconscious and on a ventilator, a family lawyer said Tuesday. He was shot several times, the lawyer said.
Police received a warrant for Brennand, but the case has not yet gone to prosecutors, McManus said.
An emailed request for comment to the Bexar County District Attorney’s office was not promptly returned Tuesday night.
The case did not appear to be listed in online court records and it was not clear whether Brennand had a lawyer who could speak on his behalf.
Brennand was responding to an unrelated jamming call at McDonald’s at about 10:45 p.m. on Oct. 2 when the shooting occurred.
He saw a car, driven by Cantu, who had avoided him earlier in the day due to a mismatched license plate, police said.
Brennand had opened the door abruptly, ordered Cantu out and opened fire as the car reversed and reversed, police said.
Brennand had been employed for seven months and was still on probation.
He is facing two counts of aggravated assault because there were two people in the car when the shots were fired, McManus said. A 17-year-old girl in the passenger seat was not injured.
McManus has said Brennand’s actions were indefensible.
