WASHINGTON, July 21 (Reuters) – The U.S. Supreme Court on Thursday refused to reinstate President Joe Biden’s policy of shifting the focus of U.S. immigration enforcement to threats to public security, with Texas and Louisiana taking a win if they challenge a plan they call illegal.

The judges rejected the Biden administration’s request by 5-4 votes to block a federal judge’s ruling that had prevented immigration officials from enforcing the enforcement guidelines while the policy’s legality trial continues. But the court said in a brief injunction it would speed up the Biden administration’s appeal and hear pleadings in December.

Biden’s policy diverged from the crackdown on the Republican predecessor to the Democratic president, Donald Trump, who sought to increase the number of immigrants who could be arrested and removed. Biden took office last year, promising a more humane approach to immigration.

Announcing the new guidelines last September, the Biden administration noted that US officials have long relied on enforcement priorities because of the estimated 11 million immigrants living in the country illegally.

The policy would give officers more freedom to consider individual circumstances and prioritize threats to national security or public safety.

Republicans have criticized the Biden administration, saying fewer detentions and deportations have led to more illegal border crossings.

Texas and Louisiana have filed a lawsuit in Texas federal court over Biden’s policies, arguing that federal officials lack discretion and are required to detain immigrants who commit a wide variety of crimes or who serve the warrant. have been given to be removed.

U.S. District Judge Drew Tipton agreed on June 10, suspending the policy nationwide. Tipton was appointed by Trump. read more

On July 6, the New Orleans-based 5th US Circuit Court of Appeals declined to block Tipton’s ruling pending an appeal.
